CJ Names 7-man Panel…As Nyako’s impeachment plot thickens

Nyako

SHOWBIZPLUSng gathered that in response to the directive earlier in the week by the Adamawa State House of Assembly, the state’s Acting Chief Judge, Justice Ambrose D. Mammadi, on Friday named a 7-man panel to investigate allegations of gross misconduct leveled against the embattled governor, Murtala Nyako and his deputy, James Ngilari, by the lawmakers.

Named as chairman of the committee, is Buba Kaimaga, while other members include Hajia Laraba Hassan, Njidda Kito, Joshua T. Abu, Mr. Binanu R. Esthon, Alhaji Sa’ad Lawan, and Mr. Esthon Gapsiso.
Chief Registrar of the Court, Abubakar M. Bayola, said in a statement that the chief judge in line with his constitutional power has constituted a seven man panel as requested by state House of Assembly.
“The Hon. Acting Chief Judge Hon. Justice Ambrose D. Mammadi   by the powers vested on him under Section 185(5) of the 1999 Constitution as (amended), has approved the appointment of seven (7) Man Panel to investigate allegations of Gross Misconduct of the Executive Governor of Adamawa State, Admiral Murtala Nyako and the Deputy Governor of Adamawa State Mr. Bala Ngilari
THE CHARGES
*The charges include alleged fraudulent award of contracts of over N8b through SNECOU Group of Companies Limited, a company linked to one of the governor’s wives to siphon public funds without delivering any services;
*The governor was alleged to have siphoned N300m public funds through a company, Hydro Source Resources Ltd in the name of construction of Mubi by-pass road without mobilizing to sight or any construction carried out after collecting N300m;
*Nyako was also accused of  gross violation of the oath of office by outrageously allowing a dominance of family and friends in the discharge of government business such as found in the MDG’s office, the SPPU and Ministry of Health.
*Besides, the governor was also accused of squandering N4,805,216,538.32 and N7,114,995,590.85 in 2012 and 2013 respectively through the Office of the Secretary to the State Government against budgetary approval, and that was not in the interest of people of Adamawa State.
*There’s a charge of ‘gross violation’ of section 120 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) and also gross misappropriation and diversion of Internally Generated Revenue for personal use to the detriment of the people of Adamawa State.
*The governor was also accused of expending N2.5b as “Other Miscellaneous Expenses”  through the Internal Affairs and Special Services Department as well as alleged diversion of N400 million out of the N500 million Federal Government intervention fund for flood victims in Adamawa State in 2011.
*Others are: “Abuse of office and violation of Adamawa State Law by appointing his wife, Dr. Halima H Nyako, as the Chairman Adamawa State Action Committee on AIDS contrary to the SACA enabling law. His government is popularly nicknamed “Government of Family and Friends.
*“Overbearing strangulation of the Local Government Areas and extortion of Local Government funds in the name of joint projects and security challenges in Mubi and other parts of Adamawa State;
*“This leaves many Local Government Areas with nothing to pay worker’s entitlements. The governor is also to consistently contravene section 168 (60 and 8) of the constitution of the Federal Republic of Nigeria.”
*UIt should be noted that the MDGs’ office in Adamawa State is managed by Governor Nyako’s close relations and was said to have squandered N220m and N786,457,644.94 budgeted state funds in 2013 for the implementation of MDG’s programmes in the state.
DEPUTY GOV…
*Diversion of public funds to tune of N50million released to the deputy governor Adamawa State by the ministry of Finance by instruction of the executive governor for acquiring license for the exploration of sold minerals in the state.
*The deputy governor was also accused of indulging in extra-budgeting expenditures  to the tune of N397,311,559.05K, among others..
 Meanwhile, the governor has said the bid to impeach him is the handiwork  of some desperate politicians of the state  based in Abuja and hell bent at removing him from office not the President as earlier insinuated by some people.
“The presidency is not planning a plot to remove me from office contrary to speculations. Because Adamawa state have a lot of intellectual people and prominent persons in government and beyond when a matter crop up like this one it attracts different perspectives and approaches to address it that is the reason for the political differences we have but not much outside interference.”
“As I was coming back from Abuja, I came to certain conclusions of all the issues raised and I find out the allegations against me are nothing too serious. Three months ago, the house itself has passed a verdict praising my administration of transparency and best performing governor Adamawa ever had, well  I don’t want them to lose that faith .
“Very soon, all forces of reconciliation will be set in motion. We will use our kinship, traditional and religious leaders to calm down the situation. I am also pleading with the EFCC to de freeze our account, Adamawa is a poor state and defend only on Federal Allocation to pay its salary so that our people can have reprieve during the Ramadan. If that was not successful I will challenge that in court as a supreme court has already says EFCC has no reason to freeze any account.”
