The father of Fast & Furious star Paul Walker has begun legal action against Porsche following the death of his son in a car crash in 2013.
It comes a week after the car manufacturer responded to a wrongful-death lawsuit filed by Mr Walker’s daughter Meadow Rain, in which the company declared his death was his “own comparative fault”.
The seven-page defence filed by Porsche stated that Walker was aware of all of the “risk, perils and danger” involved in driving a Carrera GT.
Meadow Walker’s attorney, Jeff Milam, criticised the filing, reiterating his claims that the car as sold was unsafe.
“If Porsche had designed the car to include proper safety features, Paul would have survived, he would be filming Fast and Furious 8, and Meadow Walker would have the father she adored,” Mr Milam wrote in a statement.
he 40-year-old Hollywood star was on a break from filming the seventh instalment of the film franchise at the time of the accident.
The actor was a passenger in his friend Roger Rodas’ Carrera when it crashed into a pole and burst into flames in Santa Clarita, California in November, 2013.
Now Walker’s father, who is the executor of his son’s estate, has filed a lawsuit claiming the Carrera GT his son was riding in lacked safety features that could have saved the actor’s life.
The lawsuit cites features that have been included in other pending lawsuits against the company over the crash, that it is claimed might have saved the actor’s life.
These include a stability-control system, door reinforcements and a breakaway fuel line to prevent the car from bursting into flames after a collision.
The lawsuit seeks unspecified damages.
Rodas’ widow, Kristine, who has a pending claim against Porsche in federal court, has also filed a wrongful death lawsuit against the car maker.
Investigators found that speed was the main cause of the crash with Rodas driving between 80 to 93mph (130-150kph) at the time.
Coroners ruled out drugs or alcohol as contributing factors.
None of the cases have yet been set for trial.
